Introduction and Acceptance of Terms
Welcome to OptionAvenue. By accessing or using our website, mobile applications, or related services (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree to any part of these Terms, you may not use our Services.
Description of Services
OptionAvenue operates as a platform connecting authors and literary rights holders with producers and other entertainment professionals. We provide tools, services, and resources to promote books and authors for film and television adaptations. As of January 19, 2025, our Premium Book Listings have been replaced with the Premium Author Service, a more comprehensive offering to promote authors and their works. Unless explicitly agreed upon in writing, OptionAvenue does not act as an agent or a party to any transactions.
User Eligibility and Account Registration
- You must be at least 18 years old to use our Services.
- You are responsible for providing accurate and current registration information.
- Book and author submissions are subject to approval and may be denied at OptionAvenue’s discretion.
User Responsibilities and Warranties
By using our Services, you agree that:
- You have the legal right to sell, option, or promote the rights to any work listed on our platform.
- If your book is under a publishing agreement, you have obtained the necessary permissions to use our Services.
- If you are acting on behalf of an author, you have explicit authority to do so.
- You will conduct your own due diligence before entering any agreements facilitated by our platform.
- You will not use our Services for any illegal or unauthorized purpose.
OptionAvenue’s Role and Limitations
- Facilitator: OptionAvenue acts as a facilitator and is not a party to transactions between authors and producers.
- No Guarantees: We do not guarantee the success of any deal or adaptation opportunity.
- Content Removal and Service Cancellation:
- OptionAvenue reserves the right to refuse service, terminate accounts, or remove content at its discretion.
- We may cancel or suspend services for any member or non-member at any time to protect the integrity of our platform and ensure effective curation and operation of our business for all authors and producers using our website and services.
Fees and Services
- Free Accounts: Basic accounts remain free indefinitely.
- Premium Author Service: $95/month, providing targeted outreach, enhanced visibility, and marketing services for authors.
- Only 10 Premium Authors are accepted per month.
- Premium authors’ works are proactively pitched to producers monthly, led by Kayla Bramante. A 10% agent fee applies to any adaptation deals secured through our efforts.
- Additional Services: Pricing for movie posters, AI short films, and other services are detailed on our platform.
- Refund Policy: Paid services are covered by a 30-day money-back guarantee. After this period, no refunds will be issued.
Intellectual Property
- Ownership of Original Works: Authors retain full rights to their books and manuscripts. OptionAvenue does not claim ownership of the intellectual property submitted by users.
- Ownership of Marketing Materials: OptionAvenue retains ownership of all marketing materials (e.g., AI short films, movie posters, trailers) it creates unless explicitly paid for by the author.
- Paid Marketing Materials: Ownership transfers to the author upon completion and approval after the 30-day money-back guarantee period. OptionAvenue retains the right to use these materials for promotional purposes.
- Unpaid Marketing Materials: OptionAvenue reserves the right to use, modify, or delete these materials at its discretion.
- Promotion Rights: OptionAvenue may use any created marketing materials (paid or unpaid) for social media, advertisements, or other promotional purposes.
Confidentiality and Data Usage
- Manuscripts uploaded for evaluation are treated confidentially and used solely for generating coverage or creating marketing materials.
- OptionAvenue will not share personal information with third parties except as outlined in our Privacy Policy.
Disclaimer of Warranties
OptionAvenue provides its Services on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including those of merchantability and fitness for a particular purpose.
Limitation of Liability
OptionAvenue is not liable for indirect, incidental, or consequential damages arising from the use of our Services. Our total liability is limited to the amount paid by the user for Services.
Indemnification
You agree to indemnify and hold harmless OptionAvenue, its affiliates, officers, and employees from any claims or damages arising from your use of the Services or violation of these Terms.
Dispute Resolution
Disputes will be resolved through binding arbitration under California law.
Modifications to Terms
OptionAvenue reserves the right to update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
